Family Court proceedings can take years and often intensify conflict along the way. FDR gives separated parents a direct path to address parenting arrangements and/or property settlement with proper support so that decisions can be reached sooner and with less disruption.

What is FDR, and when is it required?

Family Dispute Resolution is a formal mediation process for separated parents and is generally required before either parent can apply to the Family Court for parenting orders. It creates an opportunity to resolve parenting or financial arrangements outside of an adversarial legal process, with both parents having direct involvement in the outcome.

How FDR works at Settled

The process begins with individual sessions, where each parent meets separately with a Settled mediator to share their perspective and prepare for joint discussion. From there, Settled facilitates joint mediation, ensuring all your discussions stay focused and productive.

If an agreement is unable to be reached, our team can issue Section 60I or Section 66H certificates where appropriate. These confirm that FDR has been attempted, was not suitable, or did not result in an agreement, and may be required for court proceedings.

  • Section 60I Certificate – for parties who were married.
  • Section 66H Certificate – for de facto couples in Western Australia who have a dispute about children.
